As a consumer reporting agency governed by the Fair Credit Reporting Act (‘FCRA’) and other applicable state and federal law, Abuse Prevention Systems (APS) is committed to protecting your right to privacy.Â
This privacy policy covers our practices, policies, and security measures regarding the receipt, storage, and use of Personally Identifiable Information for background screening purposes, as well as the receipt of certain information through the Abuse Prevention Systems Website (‘Website’) for background screening purposes.
All information collected by Abuse Prevention Systems will be collected, stored, and used in compliance with applicable law, including the FCRA.

Personally Identifiable Information Collected
Abuse Prevention Systems will collect Personally Identifiable Information about you if you voluntarily choose to provide such information to APS and/or in connection with a Background Check authorized by you. Personally Identifiable Information that APS may collect through our Website or otherwise may include, but is not limited to: your name, address, email address, phone number, date of birth, birthplace, driver’s license number, social security number, employer, employment details, and information regarding prior criminal proceedings, civil proceedings or credit-related activities.

Use of Personally Identifiable Information
Abuse Prevention Systems will not disclose your Personally Identifiable Information to a third party, except in accordance with applicable state or federal law.
Typically, Abuse Prevention Systems will disclose Personally Identifiable Information regarding the subject of a Background Check to a third-party in the following circumstances only:
- To an employer or prospective employer which has been authorized in writing by the consumer to receive information about the consumer for employment purposes;
- To a volunteer organization authorized in writing by the consumer to receive information about the consumer for purposes of determining whether the consumer will be eligible for certain volunteer opportunities;
- As otherwise required by law.
End-users (e.g., employers and prospective employers) may obtain information from Abuse Prevention Systems only after the end-user/employer has certified a legally permissible purpose for receiving such information.
When Abuse Prevention Systems transfers Personally Identifiable Information to a representative or third-party subcontractor assisting with a Background Check, APS provides only the information required to assist with the Background Check. APS prohibits third-party representatives and subcontractors from using consumer information for any purpose other than assisting APS with the Background Check. As well, APS contractually requires third-party representatives and subcontractors to maintain commercially-reasonable measures to protect the confidentiality of any consumer information received.
If Abuse Prevention Systems or its assets are acquired by another company, that company will assume responsibility for the Personally Identifiable Information collected by APS, and will assume the rights and obligations regarding the collection and use of such information, as described in this Privacy Policy. Abuse Prevention Systems will not permit another entity in such a circumstance to review or examine the information APS has collected without a confidentiality agreement in place, and only to the extent allowed by law.
Abuse Prevention Systems does not resell any data provided to us for marketing purposes under any circumstances.

To protect consumer privacy and security, we take reasonable steps to verify an individual’s identity before granting access to Personally Identifiable Information or allowing corrections to such data.
Personal Information Disclosure: United States Or Overseas
Generally, Abuse Prevention Systems does not transfer information to third parties outside of the United States or its territories. Such transfers may occur only if necessary to complete an international Background Check (e.g., conducting an international criminal check or verifying educational or employment records outside of the U.S.).

Abuse Prevention Systems abides by all applicable state and federal law pertaining to the security of data supplied to us. Abuse Prevention Systems uses industry standard physical, technical, and administrative security measures and safeguards to protect the confidentiality and security of your personal information. For example, APS has established mechanisms to help maintain a secure network, encrypted back-up data, and established limits on employee access to information.
When data is destroyed or disposed of, APS follows all applicable legal requirements and regulations, using reasonable measures to ensure that all such records and data are destroyed and unrecoverable.Â
